slapdash court may ignore scientific consensus

Just when you thought the global warming argument was over, the Supreme Court is being asked to rule on the evidence…and they aren’t well-prepared to do so.
So says Cornelia Dean (via NY Times) in a review of last week’s arguments on the first such case to come before the court.
Never mind that top scientists filed a friendly brief touting the consensus view.
Lawyers deal with different rules of evidence, says Dean, and the Court may decide to decide the case according to new rules it will make up.
Some Americans may wonder if this Court is impartial, given the Bushies’ tactic of playing up the uncertainties.
If the Chief Justice doesn’t know where carbon dioxide ends up– “Troposphere, whatever,†said Justice Scalia– one wonders whether this case isn’t more about how serious our government is.
